TERMS OF SERVICE

EL TAB MEMBERS 

By applying or registering to become a member, or by using our mobile application, you agree to these Terms and the Privacy Policy.

Before you can use El Tab, you will need to register for an account ("Account"). In order to create an Account you must:

  • be at least 18 years old; and

  • be legally permitted to use the App by the laws of your home country.

El Tab has absolute discretion over who it accepts as a member. Our selection process is determined on a first come, first serve basis and does not discriminate based on age, gender, race, religion or sexuality. El Tab reserves the right to suspend or withdraw memberships at its absolute discretion.

THE SERVICE

The App operates as a daily, digital bar tab. Single or multiple bar tabs are released every day of the year, unless otherwise communicated. If their notifications are turned on, members will be notified when the tab(s) are released via push notification. 

Tab values vary on a daily basis. Tab locations also vary on a daily basis, but focus on Zones 1 & 2, London. Members can use the app to redeem up to a maximum of 4 drinks until either the tab has run dry, the venue closes, or 12.00am GMT (whichever comes first). 

The types of drink that can be redeemed vary, but are specified within the app for that particular day. Drinks not specified within the Tab cannot be redeemed.

As part of the monthly subscription fee El Tab also provides a ‘Perks’ function. These are random offers in addition to the tabs, which members can redeem at the tab venues. Perks appear on the app at the same time as tabs and disappear either when redeemed (by swiping upwards), or at midnight.

LIABILITY

i. El Tab is not liable to any member for a participating venue that refuses to honour the advertised promotion or discount. El Tab accepts no liability for any experiences at participating venues. El Tab shall not be liable to any member or guest for any loss, damage or injury suffered by them or their property howsoever caused, save in respect of death or personal injury to a member to the extent caused by the negligence of El Tab. This is not intended to affect any mandatory rights a member may have under local law that we cannot legally restrict or exclude, and nothing in these terms of membership limits or excludes our liability for negligence causing death or personal injury, or for fraudulent misrepresentation, or for anything which may not legally be excluded or limited. Members are allowed multiple accounts, but we do not encourage this. We strongly support responsible drinking and encourage members to enjoy the app in a responsible way. Please contact el Tab or Drinkaware if you are concerned about your drinking habits.

ii. Offers advertised on our app are only available to members that have subscribed and who present a digital El Tab tab. El Tab accepts no liability for any charges members incur as result of being unable to present their El Tab app at a venue (for example, if their phone runs out of battery, if they accidentally swipe away a Perk, or if there is a technical error with the El Tab app). Up to 4 drinks can be redeemed through the app until either: The tab has run dry (all money has been spent); the venue closes; or 12am GMT, upon which time the tab automatically closes. Once a drink had been redeemed members will have to wait for 15 minutes until they can redeem another drink. Members should allow bar staff to redeem both tab drinks and Perks. El tab accepts no liability for members losing drinks or offers by accidentally double tapping tabs or swiping Perks themselves.

PARTNERS

i. Entry to partner venues is always at the venue's discretion. Reasons for refusal of entry may include, but are not limited to, private events, full capacity of the venue, operating an over 21s policy, adherence to the dress code, inebriation. It is the responsibility of members to check the policies for each venue.

PAYMENT

  1. If you subscribe for membership, payments will be made according to your payment plan and will automatically continue on a period-by-period basis. Members may unsubscribe at any time but it is the members’ responsibility to cancel before their subscription renewal date. If we are unable to take payment on a particular month, membership will be suspended until new payment details have been supplied. 

  1. The standard subscription tier is £24.99/month and gives the member access to all the nightly tabs and Perks.

  1. If you unsubscribe in the middle of a month, your membership will continue until the end of your paid membership period. Refunds will not be issued, except in exceptional circumstances and at the discretion of el Tab. If you choose to use our ‘POWER UP’ service on a particular day, £2.99 will be debited from your account. Using the POWER UP service will give you access to the next tabs 30 minutes before all other members.

  1. Occasionally el Tab runs a promotion whereby new members can use a promotional code to unlock a 7 day trial for £1. Once the 7 day trial has elapsed the selected monthly subscription will automatically commence. It is the responsibility of members to cancel before the 7 day trial completes to stop the full membership from being activated. Each device will only accept one promotional code. Each promotional code will remain active for a specific period.

PERSONAL DATA

i. We will use your personal data in accordance with our Privacy Policy.

AMENDMENTS & WAIVER

i. We may amend these terms of membership at any time, for example, where we add new services or features or where there is a change in applicable law. All such changes will take effect once these terms of membership have been updated and you will be assumed to have accepted any such changes if you continue to use our website or mobile application after the latest update.

ii. If any of these terms of membership is found by a court or a regulator to be invalid or unenforceable the other provisions shall continue to apply to the maximum extent legally permitted. No waiver of any of these terms of membership shall be effective unless made in writing by us and a waiver (or non-enforcement) shall not be construed as a waiver of any subsequent breach.

NOTIFICATIONS

i. We may provide you with emails, text messages, push notifications, alerts and other messages related to the App, such as enhancements, offers, products, events, and other promotions. After downloading the App, you will be asked to accept or deny push notifications/alerts. If you deny, you will not receive any push notifications/alerts. If you accept, push notifications/alerts will be automatically sent to you. If you no longer wish to receive push notifications/alerts from the App, you may opt out by changing your notification settings on your mobile device. With respect to other types of messaging or communications, such as emails, text messages, etc., you can unsubscribe or opt out by either following the specific instructions included in such communications. 

GOVERNANCE

i. These terms of membership shall be governed and construed in accordance with English law and each member agrees to submit to the exclusive jurisdiction of the courts of England or, where required by local law, their local court jurisdiction (for example the Scottish courts if the member is normally a resident of Scotland).

Welcome to the El Tab Privacy Policy. This explains how we collect, store, protect, and share your information, and with whom we share it. We suggest you read this in conjunction with our Terms and Conditions.

When we refer to ‘personal data’ in this Policy it means any information that relates to you from which you can be identified.

By applying or registering to become a member, or by using our mobile application, you agree to the terms of this Policy, so please read it carefully.


WHO ARE WE?

Our mobile application is operated by El Tab Limited, a company registered in England and Wales under registration number 12467333 with registered address at 4 Stannary Street, London, SE11 4AA (“El Tab”, “we”, “us” and “our” being interpreted accordingly).


WHAT PERSONAL DATA MAY WE COLLECT?

We may collect the following personal data about you:

  • Personal details you provide (such as your name, date of birth or e-mail address) when applying or registering as a member;

  • Information about your debit/credit card and bank account information that we may require for the purpose of administering your membership

HOW WE USE YOUR DATA

We may use your personal data in the following ways:

  • To acknowledge, confirm and deal with your membership application or registration (and where necessary put you on our waiting list);

  • To contact you in connection with app updates and new information regarding either the website, the app, or the business in general;

  • Where we are asked to deal with any enquiries or complaints you make;

  • Where you are a member, to provide you with membership services and administer your membership account;

  • For internal business/technical operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes and as part of our efforts to keep our website and mobile application secure;

  • To combine your personal data with other information we collect about you for the purposes set out in this Privacy Policy; and/or

  • For other purposes which you have consented to.

DISCLOSURE OF YOUR INFORMATION

We may share your personal data with third parties in the following situations:

  • Making personal data available to selected third parties who act on our behalf to support our operations (for example, card processing or payment services);

  • Making personal data available to our IT suppliers and contractors (e.g. data hosting providers or delivery partners) when they may need to have access to your personal information to provide IT support or enable us to provide membership services and other goods/services available to members on this website or through our mobile application;

  • Making personal data available to drinks partners who may want to retarget members who have redeemed specific offers within the app;

  • If we sell our business or our company assets are acquired by a third party, in which case personal data held by us about our members or customers may be one of the transferred assets;

  • If we need to disclose your personal data to comply with a legal obligation or to enforce our Member Terms and Conditions, Partner Terms and Conditions, membership rules or other applicable contract terms that you are subject to; and/or

  • To protect us, our members, partners or contractors against loss or damage. This may include (without limit) exchanging information with the police, courts, law enforcement organisations or otherwise as required by law.

AGE POLICY

Although we want as many people as possible to enjoy El Tab, you have to be at least 18 years old to use the App.

El Tab does not knowingly collect any information about or market to children, minors or anyone under the age of 18. If you are less than 18 years old, we request that you do not submit information to us. If we become aware that a child, minor or anyone under the age of 18 has registered with us and provided us with personal information, we will take steps to terminate that person's registration and delete their Registration Information from El Tab. If we do delete a profile because you violated our no children rules, we may retain your email and IP address to ensure that you do not try to get around our rules by creating a new profile.

PAYMENT INFORMATION

Any credit/debit card payments and other payments you make through our mobile application will be processed by our third party payment providers and the payment data you submit will be securely stored and encrypted by our payment service providers in accordance with current industry standards at the time of processing.

We may arrange card or payment data you submit in support of a subscription to be stored for the purpose of processing and collecting any membership or other fees due. 



SECURITY

Your personal data may be transferred to and stored at a destination outside the European Economic Area (the “EEA”) such as by our subcontractors in the Ukraine. In accordance with applicable law, we will make all reasonable efforts to ensure that our subcontractors comply with appropriate and applicable security standards required to protect the personal data that they handle.

Unfortunately, the transmission of information over the internet or public communications networks can never be completely secure. We will take appropriate technical and organisational security measures to protect your personal data against unauthorised/unlawful access or loss, destruction or damage, but we cannot 100% guarantee the security of data that you provide to us online.

YOUR DATA PROTECTION RIGHTS

Certain applicable data protection laws give you a right to receive information about the personal data we hold on you. You may also have the right to ask us not to process your personal data for marketing purposes or where the processing of your personal data is causing unwarranted damage or distress. You may also have the right to ask us to delete or correct any personal data that we hold about you which is inaccurate or no longer relevant.


CHANGES TO OUR PRIVACY POLICY

Any changes we may make to our Privacy Policy in the future will be posted here. This policy replaces all previous versions and is correct as of April 2024. We reserve the right to change the policy at any time. Please check back frequently to see any updates or modifications.
